Terms of Service
These terms cover your use of Yearloom. They're written in plain English to be readable. If anything is unclear, email hello@yearloom.co.
By using Yearloom, you agree to these terms.
What Yearloom is
Yearloom is a service that enhances and captions children's artwork, then lets you save it as a digital gallery and (eventually) physical printed volumes. It's a small business run by a solo founder.
Who can use Yearloom
You must be at least 18 years old and the parent or legal guardian of any child whose artwork you upload. By using Yearloom, you confirm both.
Your account
You're responsible for keeping your Google account secure. Use a strong password and enable two-factor authentication on your Google account. We're not responsible for unauthorized access if your Google account is compromised.
Artwork you upload: ownership, license, and your warranties
You retain full ownership of any artwork you upload to Yearloom. Yearloom claims no ownership of your child's art.
However, by uploading artwork, you grant Yearloom a perpetual, worldwide, royalty-free license to:
- Store the artwork in our database and storage
- Process the artwork through AI services (Anthropic, Replicate) to generate enhanced images and captions
- Display the artwork back to you and any household members you authorize through your gallery
- Use anonymized versions of artwork (with no identifying information about your child) as examples in marketing materials, social media posts, blog content, press coverage, and product demonstrations, provided we do not name your child, family, or location
This license is necessary for Yearloom to function and to grow as a business. You can revoke the marketing-use portion of this license at any time by emailing hello@yearloom.co (within reasonable time — already-published materials may not be retractable).
Your warranties (this is important):
By uploading artwork, you warrant and represent that:
- You are the parent or legal guardian of the child who created the artwork
- The artwork was created by your child (not copied from a copyrighted source, not created by another family's child, not created by a professional artist)
- You have the full right and authority to grant Yearloom the licenses above
- No third party (including the other parent, co-guardian, or any other family member) will have a valid legal claim against Yearloom for displaying or processing the artwork
Your indemnification:
You agree to defend, indemnify, and hold harmless Yearloom (its founder, employees, contractors, and affiliates) from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Any artwork you upload that violates the warranties above
- Any claim by a third party related to ownership or rights in the artwork
- Any misuse of Yearloom by you or anyone using your account
- Any violation of these Terms by you
In plain English: if you upload someone else's child's art and they sue us, you're responsible for our legal costs. So please only upload your own family's artwork.
Acceptable use
You agree not to upload:
- Artwork that isn't your own child's (no copyrighted material, no other families' children's work without permission, no professional artist work)
- Content that is illegal, harmful, or violates anyone's rights
- Content that could endanger or exploit children in any way
- Automated mass uploads (Yearloom is for thoughtful family use, not bots)
- Content that is hateful, discriminatory, sexually explicit, or otherwise inappropriate
We reserve the right to remove any artwork that violates these terms and to suspend or terminate accounts that repeatedly violate them, with or without notice.
Captions we generate
The captions Yearloom generates are produced by AI. We make no guarantee that any specific caption will be perfect, appropriate, or accurate. You can edit, regenerate, or delete any caption at any time. Yearloom retains no special intellectual property over generated captions — they're part of your gallery.
Email communications
By creating an account, you consent to receive emails from Yearloom, including welcome messages, product updates, feature announcements, occasional founder notes, and essential account communications (billing, security, terms changes).
You may unsubscribe from marketing and product emails at any time via the unsubscribe link in any email. Essential account communications cannot be unsubscribed from while your account is active.
Subscriptions and billing
Free tier: 5 lifetime pieces, then view-only access.
Paid tiers: monthly or annual subscriptions managed via Stripe.
By subscribing, you authorize Yearloom (via Stripe) to charge your payment method on a recurring basis. You can cancel anytime from your account page; cancellation takes effect at the end of your current billing period.
Refunds
If you cancel within 30 days of your first payment, email hello@yearloom.co for a full refund. After 30 days, refunds are at our discretion but we generally honor reasonable requests.
If a technical issue prevents you from using Yearloom for an extended period and we can't resolve it, we'll refund the affected billing period.
Intellectual property
- You own your uploaded artwork
- You own the AI-generated captions (we claim no rights to them)
- Yearloom owns the software, design, brand, AI prompts and systems, and operational infrastructure
- "Yearloom" and any logos are trademarks of the business
Third party services
Yearloom relies on Google, Supabase, Amazon Web Services, Anthropic, Replicate, and Stripe to operate. We are not responsible for outages or issues with these services, but we'll do our best to maintain reliable service overall.
Warranty disclaimer
Yearloom is provided "as is" and "as available." We do our best to make it reliable, beautiful, and useful, but we make no warranty that it will be error-free, available at all times, secure, or meet your specific expectations. We disclaim all warranties, express or implied, to the fullest extent permitted by law.
Limitation of liability
To the maximum extent allowed by law, Yearloom's total cumulative liability to you for any claim related to the service is limited to the greater of: (a) the amount you've paid Yearloom in the past 12 months, or (b) one hundred US dollars ($100).
We will not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, loss of profits, loss of business, or loss of artwork (please don't rely on Yearloom as the only copy of your artwork — keep your originals).
Termination
You can stop using Yearloom and delete your account at any time. We can suspend or terminate accounts that violate these terms or that we believe pose a risk to other users or to the service, with or without notice.
If your account is terminated, you can request a copy of your data within 30 days. After 30 days, we may permanently delete it.
Changes to these terms
We may update these terms periodically. If we make significant changes, we'll email active users at least 30 days in advance. Continued use after changes constitutes acceptance.
Governing law and disputes
These terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. Any disputes arising from these terms or your use of Yearloom will be resolved exclusively in the state or federal courts located in Santa Barbara County, California, and you consent to personal jurisdiction in those courts.
